Does anybody know when the FAA is planning on enacting the new section 107 to replace the current 333 exemption? I'm looking to do some commercial flight but don't want to file a 333.

Aloha lriley,

     As noted by MyDrone in the video he provided above, Section 107 may not get passed before the break.  In anticipation of this problem, the FAA is considering an implementation of the micro-drone commercial ticket as a hold-over.  Requiring a manned aircraft pilot's license for drone flights was never meant to be a long term effort of the FAA.  If the FAA decides to go this route, it is supposed to be announced this month.

     The reason the video update of the AMA provided by MyDrone did not mention this is because the AMA serves model aircraft enthusiasts and they are not interested in commercial operations and the problems being created by Congress in this area.  Hope this helps!

Aloha kirk,

     Do not try under the current regulations unless you have a manned aircraft license.  Wait out the month because next month is summer break for Congress.  The FAA will act in June if they are going to act.  So wait out the month at the least.  You have waited this long, a little longer will allow you to make a much better decision.  

     The FAA wants to get rid of the manned aircraft licensing requirement and they will do so as soon as they can.  It is the manned aircraft licensing requirement that is causing the biggest headache for the FAA regarding commercial certifications for UAVs.  They have to expend too much money on enforcement because the requirement is unreasonable, they know it and it was only intended as a stop-gap measure.  The requirement has overstayed its usefulness and is now problematic.

The 333 Exemption is free, why not submit a petition anyways. That way if nothing happens then in 6 months you'll have an exemption and all is good (except you'll need to hire a pilot)

Even if you have a pilots license and your company gets a 333 exemption, you can't fly within 500 feet of person or property so it's pretty much useless unless you're doing farm survey work or nature photography outside of national forests.

withint 500 feet of people? I don't think that's true, I see tons of approved businesses who do music videos and such are guess what, theyre right by people. Or even concerts.

Correct, no need for a a pilots license to get an exemption. Only needed to use it.

Unless I missed something, I didn't see where this video addressed the commercial use of UAVs at all. Just the regulations for model (hobby) aircraft.

FAA does not distinguish between drones and model aircraft. This is one of the things that needs to be fixed. Under current FAA rules a drone is a UAV as is an RC aircraft.
My understanding of the efforts to remedy this is as follows: There has been a substantial effort to fix the commercial restrictions by attaching them to the FAA Reauthorization bill. This is what now seems unlikely to occur this year. Supposidly, the FAA is to propose new rules for drones, possibly as early as this month, which could create the 'Micro Drone' category and remove most of the onerous restrictions on commercial use. But even if FAA proposes new rules for drones will it take effect immediately? I don't know. I guess we will have to wait and see. I'm not holding my breath though.

One ( admittedly speculative ) reason not to get a 333 exemption is that if you do,  you will then be bound to rules that will not apply if the FAA rule proposals regarding uas are passed.
