Air 3 won't gain altitude when RTH

So I'm flying let's say at 40m and I have set the RTH altitude at 70m, it will return at 40m. Why? It forces me to manually gain altitude to 70m before I enable RTH. I don't know if it's because I fly over sea that it thinks it's safe and it doesn't gain altitude but the area is full of parasailing.

Yeah RTH has 2 modes: Optimal and preset and it is on optimal by default. I didn't notice that. My last drone had just one mode. Optimal mode doesn't strictly follows the preset altitude. So mystery solved.
