Yes it did happen to me with more then 25H of flying the spark.

On my first paid job, with the drone. I burst with Spark against the church tower in sport mode.

Yes, I was surprised by more than 25 pigeons, they were on top of the church roof on the other side of the tower ...



Sport mode only in Large and unobstructed locations... Learn my lesson the hard way...

Hopefully you can get this repaired.  I must also commend you for "owning" this incident.  There have been lots of cases of individuals who make the claim "it's DJI's/Spark's fault", and then get offended when their contribution to the incident is pointed out to them.  You are taking the right approach.

I did push the sport mode to get way from the pigeons!...
It is my fault...
I Just bought another one.
I will try to repair the damage drone.

I think that it does.. Anything that results in you having the broken drone to return to them is covered.

a lot of birds and probably a couple nests you bothered.  if you have refresh definitely get it refreshed, they cover things like this.  however have to be very mindful that the spark is a lot weaker in terms of fighting against attacking birds and such.. i would recommend a mavic or a phantom as a main drone and a spark as backup/sidekick drone..because mavic and phantom can probably take a head on collision with a small/medium bird and recover itself, a spark just isn't going to do that. if it gets hit its going down,  fast.. i have gotten a prop caught in a tree limb with my mavic (during an active track) and it untangled itself and recovered itself before hitting the ground..

not saying spark is the wrong tool for the job, it is a fantastic drone i used to own one, but sometimes need the heavy duty tool.   im probably going to buy myself another spark at some point in the future to supplement my mavic pro that i replaced it with since.. (my personal opinion on the spark is it isn't a finished product)

So sorry to hear about this. I too had an unfortunate incident with my Spark and the damage looks very similar to mine.

I agreed with HereForTheBeer. As a mini drone, spark will get hurt easily when it encounters flying objects. So please pay more attention to the flying environment.

My son was on his 3rd battery of the evening when it suddenly ejected itself from the drone. It was about 10-15 feet up when it happened and about 10 minutes into the flight.

Most don't have the DJI Care...and try to get it covered with normal warranty.

The point for me is that if dji refresh covers pilot error or technical failure, either way it folows it is responsible for any mishaps that might result, ie 3rd party liability. In this case it is a must.
But that is unlikely, and I imagine a stipulation of any cover wouldinclude the flight having been begun and conducted until loss of control legally, which for the vast majority of the time it is not.  

I feel sorry for your loss and think your response is great.
And thanks for reminding us what 'not' to do!

Please notice that it is not allowed to use the DJI refresh when your spark lost. That's why flyaway is not refundable. Please check the exclusions below. Thanks for your understanding.

It won't affect the flight performance if you change your battery without cooling down the AC. But your hand may feel the heat and you can decide to change the battery or not.

Well it's not lost if you hit something and they come looking.

I was considering doing paid filming, but I found the cost of acquiring the necessary license, insurance and regisration, together with the writing of a risk assessment and projected time and planned flightpath and notification of the relevent authorities to make it all legal was prohibitive

I have the drone!... but i don't have Care Refresh on this one.

Manage to turn on the drone...

    - gimbal is working!!!!
    - camera is working!!!!
    - the internal fan is making a strange sound...     
    - 4 motors did start...

This is broken inside!...

I thunk that this is imu module...

Hey, sorry to hear about your spark and taking responsibility for the accident.  Accidents do happen specially where things like birds, buildings are in the area of flight.  Given you have the DJI Care Refresh program, your spark is covered for pilot error or in this case bird error.  Contact DJI Support to get your spark replaced.
