In a perfect world I'd agree with you, and even if the FAA took your approach I'd say the press will still sensationalize the whole affair so the drone community would still take a hit.

When UK near misses/collisions are investigated they always decide on if the two aircraft where entitled to be there and it seems to be about the most important factor in deciding blame. If a drone is in the approach to an airport then the drone is in trouble, if not and it is within VLOS (<1800ft altitude) then they consider if both pilots took suitable avoidance action.   If you are flying low then you have to fly in a manor where you can avoid other aircraft/birds/children's kites/and anything else you are likely to encounter there, and be able to spot people so that you can keep the required 150m distance.  Flying at 600mph at 100ft is not safe.
