I have  a Phantom 3
Very new to this its 2nd hand
it flys and controls well then it gets confused spinning around sometimes falling to the ground
It can sit and hover for a minute or so then just wonder of on its own
It can be a bit of a struggle to get it to come back ,then all of a sudden its perfect again
So is this common
is it fixable
this is giving me a terrible start to a hobby
Please no B/S high tech replys or bagging out

No, it's not normal.
Phantoms are usually very steady and reliable - they just about fly themselves.
is it fixable?
That's hard to answer without knowing what the issue is.
To get some idea of what the issue might be, a look at the flight data might be helpful.
Go to http://www.phantomhelp.com/LogViewer/Upload/
Follow the instructions there to upload your flight record from your phone or tablet.
Come back and post a link to the report it gives you and someone might be able to analyse it and give you an understanding of the cause of the incident.

PS   make sure you aren't trying to launch from a steel or reinforced concrete surface.

From reading your previous thread, you may have some damage caused by the crash.  Why don't you start by calibrating the IMU.  Next, I would check compass.  Don't calibrate it unless it tells you to.

Check the IMU and compass too and calibrate them if it´s required. Check the RC too via RC menu in app.  Look how many  satellites are in catch of your AC. If the AC catch in the time you take off more than 5 then it hovers on place. If it´s catch after 2 or 3 minutes less than 5 then it´s beginning to drift with the wind.
