It's not just about what is below the drone, all it takes is for a plane/helicopter to not see the drone in time and take out an aircraft. if your below 400ft your underneath the minimum height of flying aircraft, that would make your chances of hitting a craft basically 0% unless your flying at an airport/landing site which you shouldn't be. While flying at 5k feet it is unlikely you would hit an aircraft(the sky is a big place), but it's not impossible and it would be peoples lives that are at risk, your drone doesn't have any form of transponder or radar detection and is basically an spec of dust which a pilot is unlikely to spot. So no it's not safe or legal.
