Hmm, what i do not understand is, why everyone is putting the MA2 into the category A3 ?
If i read the details of the current EASA CAP1789 categories/subcategories and compare them with the MA2 specs, it should be fit perfectly into A1/C1.

EASA A1/C1:  <900g MTOM                MA2 spec : 570g
EASA A1/C1:  max. speed 19m/s       MA2 spec : max. speed 19m/s

EASA A1/C1: The standards also cover other aspects such as noise limits, height limits and requirements for remote identification and geoawareness systems.
MA2 spec: already implemented incl. low noise props

Even if the low-speed mode which limits the maximum speed to 3m/s by a switch comes into the account, DJI can easily reduce the "T"-mode from 5m/s to 3m/s with a firmware update.

And over all, the registration and competency requirements can be obtaIned by everyone if not already done.

So from my point of  view, there is nothing to worry about for the future.

Because the MA2 is not C1 classified and is therefore a legacy drone weighing 250g to <2kg. It has also been confirmed that all current drones will not be retrospectively certified and will remain legacy-transitional unless it has a <250g MTOM.

Whether DJI can push for drones like the MA2 to be C1 classified is to be seen but as things currently stand the MA2 will fall straight into the A3 subcategory from 31 Dec 20 unless you have the A2 CofC to fly it in the A2 until 31 Dec 22 (legally).

By whom then the MA2 needs to be specifically classified, DJI or EASA ?

EASA will be classifying the drones,  as it currently stands they will need to be marked from the factory like a CE mark and cannot be retrospectivly classified,  of course this may change but its been pretty consistent for a while now,  just due to covid did they extend the start until December.  In the mean time I don't believe there is a way for a manufacturer to get the EASA to do the classification yet.

It is the responsibility of the manufacturer of the product (DJI) to ensure that the product meets the safety requirements to be certified with the new CE marking to comply with EU legislation and thus ensure that the product is fit to be sold within the EEA.

The EASA are responsible for defining the classification of each drone in line with the new laws. The EU for setting out the declaration of conformity and DJI for labelling the drones with the new CE markings and conforming to the CE standards set by the EU in accordance with the EASA drone classification.

Due to the EASA delaying the classification process twice this has led to DJI having to release the Mavic Air 2 in April this year without the new CE classification that would have legally conformed to the new CE markings/drone class ratings. As such, every DJI drone on the market today will be a legacy drone from 31 Dec 2020 including the Mavic Air 2.

We call that a scooter.  There are a couple down my road but they are totally illegal here to use on the roads or pavement.   Unless you hire one as part of a government trial in one of the major cities.

Ah ok.
Scooter is something different here.

I'm not sure if the 'scooter' is legal here, but we have those (as well as motorized skateboards)

Thanks for clarification.
Let's hope the EASA has already the files from DJI on their desks and they will classify, even with the current corona delay, the already sold MA2's as C1.

Unless they change the rules current drones will not be retrospectively classified.  And as it stands would not have the slow speed mode without an update so woukd still be in a naff class anyway.

If DJI have the labels they will be added to future drones for sure but as DAFlys pointed out adding them retrospectively may not be possible unless there is a recall process and I strongly doubt that will happen due to the logistical nightmare and limited resources to do it.  DJI will not be under any legal obligation to accommodate and it would not be cost effective for them either.

Whether future MA2's will be certified for prospective customers is indeed a possibility if the existing model conforms to the strict guidelines to be C1 certified. That said the max speed is capped to 42.5mph, it weighs <900g, it has remote ID installed, it has low noise props with sinusoidal ESC's, it has a tripod switch which could reduce the speed instantly to 3.5mph with a FW update and it has GEO fencing with OcuSync tech and obstacle avoidance. It is an all round safer drone than the Mavic Mini so it is just a damn shame it doesn't have that label and hits A3 because of a few hundred grams and EU delays...
