Its legacy,  only new drones can be classified and this is currently no process for that.

Since the Spark's takeoff mass is above 250gr, but below 500gr, it can legally be operated in the A1 subcategory of the "open" category (which is nice).
This is valid until Jan 1st 2023. After that, the Spark can only be used in the A3 subcategory, meant for DIY drones. At least thats how it is for Austria now...don't know if Spain has also adopted the new rules.
