Excellent set of rules.  Hope FAA final rule is similar, but with a slightly higher ceiling of 400 feet.

The problem with a higher ceiling is that you will be flying at the same altitude as maned aircraft.  400 f ceiling is for safety, it is airspace where no one is suppose to be.

A 400' ceiling for remote controlled aircraft has been the safety standard in the United States since 1981 (see 1981 Advisory Circular setting 400' as the recommended ceiling for RC aircraft

It has worked well for over 30 years to keep the flying public alive because amateur groups have been effective in educating their members about the grave danger of flying higher, since manned aircraft operate as low as 500'.  Canada has chosen ~300 ft  (90 meters) as a standard, which provides plenty of altitude for both recreational and commercial operations.  In this country, however, responsible UAV pilots adhering to the voluntary 400' safety recommendation for over 3 decades have proven that 400 feet is a safe ceiling for UAVs, and is therefore a reasonable operational ceiling to impose on these vehicles as the US government moves to impose laws governing their operation.

400' or 4000', day or night there must be some common sense guys. First of all make to much training to have the experience to fly at that altitude or even (why not) night flying. Afterthat have a thoroughly look at your surrounding airfield, if it is very dense of low flying aircrafts then even the 400' are impermissibly to fly radio controlled models. Come on guys don't expect for everything and everytime strictly law for the obvious. And always have an emergency plan to overcome uncommon conditions (train much for these).
