Twice now my mini 3 pro has done a emergency/forced landing with a full battery withouth returning to home.
Each time the height has been minimal and the area I fly in is unrestricted.

Can someone shed light on why this happens and how one can override it and simply ask it to return to home?

Yes ... if you post the recorded flight data from one of these flights so I can see what actually happened.
Go to: https://www.phantomhelp.com/LogViewer/Upload/
... where you'll find instructions.
That will give a report you can post a link for the report here.
Or just post the .txt file.

Hi, Raztec. Thank you for reaching out and we're sorry to read about this. Was there any message from the DJI Fly app before the forced landing? Also, is there any video showing the issue? If yes, please provide us with the video and sync the flight records, and then PM us your DJI account and the flight time.

As suggested by Labroides, post the flight logs for BOTH affected flights.
How long before the flights did you charge the battery or batteries?

The batteries were freshly charged.
How to I upload flight logs and where are they?
I don't believe I was recording the screen or video

"How to I upload flight logs and where are they?"
Did you look at the instructions Labroides mentioned?

Hi, Raztec. Here are the steps on how to sync the Flight Records on the DJI Fly app:
1. Launch DJI Fly, 「click Profile – More – enter Flight Data Center」;
2. When "Auto-sync Flight Records" is not enabled, there will be a pop-up window that asks whether to enable it once you enter this page;
3. If the pop-up prompt is canceled, you can still select the quick button "enable" that displays at the top of this page;
4. You can also manually enable it by Profile – Settings – Sync Flight Data – Auto-sync Flight Records.

Note:
Please ensure that a flight record showing the issue is present. If not, please try to recreate it.
Auto-sync Flight Records is the process of uploading the local data of the mobile device to the DJI cloud server and downloading the server data to the mobile device.
During the auto synchronization, please ensure that the mobile device is under an available network service.

You are 1.1km from the end of a runway, at a guess less than 530m from the flight path into and out of the Nelson Airport. Though https://nrc.canada.ca/en/drone-tool/
shows that drone flights are permitted.
The first log also warns you that you are in a Airport warning zone.
All 4 logs tell you that either the gimbal cover is on or that there is a problem with the gimbal.
None of the logs show a critical battery, none show a full battery, 40-06 starts at 89%, 28-25 ends at 81%.
I think three of the logs show a normal, throttle closed landing and 49-27 might show a grab and twist.
Would you care to try for the correct logs?

Can someone simply tell me if such a forced landing by the drone with no ability to override it is an occurrence at all?
I just want to know if this is something that can and will happen under the right circumstances.

Yes .. If you were to launch close to an NFZ without waiting for GPS and flew into the NFZ.
When your drone did receive location data from GPS, you would find yourself in a forced landing situation.
You would still be able to control the drone to try to fly back, but you couldn't stop the descending while you were in the NFZ.

OK. That probably explains it. I am near an airport. However, I have permission to fly here and do so successfully 38/40 times.
Just those two occasions is when the drone landed itself without any ability to override it.
Perhaps, I didn't wait long enough for the GPS signals to register. I will remember that in the future when I get my damaged drone back.
