I wanted my problem solved two weeks ago, now i don't care... whats left is going back in box for a refund.
My post may help someone that has a similar issue what will your post do ?

My friend, you won't get a refund that way....you have to play the DJI game because in order to get anything you have to follow their policies.....if I may..., take a deep breath...get an RMA from Support and send it back to the address they supply. Tell Mark (DJI) what your RMA number is once they receive it. He will expedite it I'm sure. Once you get notice back from Support you can take it from there...you usually will get a choice of a replacement, if warranty, or how much it's going to cost to fix if pilot error....Take the steps first then decide what to do from there...just some advice from a guy who's been dealing with DJI for quite awhile....

Imagine you buy a car, drive it around a bit, then crash it.
Now you blame the manufacturer for the damage to your car and ask for a refund.
Do you really think that this is the correct procedure?

Where did you buy this drone, and what makes you think you're going to get a refund for a crashed drone?  If you bought this directly from DJI, I don't think you have a snowball's chance of getting a refund at this point.

Wrong analogy, try this.

Imagine you buy a car, drive it around a bit, and your in a crash  due to brake failure which was a  manufacturer fault  .

In your initial post of this thread you were merely speculating that the Mavic was to blame for the crash.
Now, all of a sudden you seem absolutely certain that the Mavic caused the crash.
Do you have proof?
What was the reply from DJI?

I don't know how that would hold up in a UK court, but over here that would likely be countered with:  "Oh, that was Bob that wrote that.  We had to sack him because he kept saying untrue things to customers."  

At any rate, this is turning out to be an interesting case so far.  You flew the Mavic with a stone in the motor (because DJI told you to... maybe that was 'Bob' too!).  No proof where that stone came from.  This Mavic was a replacement, and not even the one that Apple sold you.  Drone falls out of the sky, quite possibly because of the stone.  Now you're going to return a broken drone to Apple that wasn't even sold to you by Apple, a year after the purchase.

There are lots of interesting things going on here from a legal standpoint.

I'm not trying to pick anything apart.  And even if I was, what do you care?  I'm not going to be sitting on any jury, nor are my comments going to change anyone's mind.

I simply said it was interesting.  And is IS interesting to me.  Mainly because I have no experience with this EU law and I'm interested to see how it all turns out.

If it's still under warranty and IF it's a manufacturer defect, then it should be replaced, full stop.  The refund thing is where stuff starts to seem hairy to me.

How the stone got in the motor is obvious.  They gave you a refurb that had previously been wrecked and repaired, which is S.O.P. for them.

1 I didn't fly with a stone in the motor, I reported that there was a stone in the motor theres a big difference here. Just by inverting the drone i could get the stone out but my big question to DJI was will there be damage and how did it get in the motor.
2 i'm still within my 1st year of warranty.

I still don't understand the purpose of this thread.
If DJI gave you the written confirmation that the crash of your Mavic was their fault, then where is the problem?

Listen.... NASA with all their tech could not have controlled my Mavic before it crashed.  Go troll somewhere else, If you can't understand whats going on by now then theres no hope for you

I think your thread/post is important, to others who have had similar problems with same malfunction symptoms.
How ever it would be helpful if you could get a proper diagnosis from dji as to what caused your aircraft to malfunction and crash, this diagnosis would be helpful to others.
Hope you get your replacement soon and everything is ok with it.

I am sorry for the crash. I would still answer your post to see if there is something I could help. It seems that you had contacted our support and waiting for the result, right? Could you please provide me with your ticket number so I can check some info for you? BTW, we don't have the mechanism for the drone in Sport mode like you mentioned above. And I hope everything will be sorted out soon.

I know how frustrating and annoying this situation is to you. I assume you've already got your refund from Apple?  If not, have you not tried yet or was it rejected?  
If you haven't got your refund, then all I can suggest is that you take up Thor's offer of help here.   Getting annoyed at people trying to help you will not solve anything; let Thor initiate a second look and try and get this resolved.  Keep a cool head.

If you do go into Apple to get your refund rather than working with DJI, please try to secretly record the encounter.  I think it's sure to be a youtube hit, if you're into such things.

You: Hi, I'd like to return this drone.
Apple: Sir, this drone is in a million pieces
You: It was a product defect.  DJI told me so on the phone.  It's really defective now.  You have to take it back under EU law.
Apple: Ummm this serial number doesn't even match the one we sold you.  Are you trying to pull the ol' switcheroo on us?  People buy new items and then try to return their old broken ones to us all the time.  How stupid do you think we are?
You: Well there was this jitter, and this stone, and look at this green line on some other guy's log, and... and...
Apple: Sir, you'll have to take this up with DJI.  We'll be happy to refund your money when you return the drone with the proper serial number.

I honestly just don't see it turning out any better than that.

Hi Ian,

I watched your video a few weeks back (when my drone crashed) I'm really sorry about your drone, was keeping the fingers crossed that you would find it.

Well, Thor can be very helpful, but being antagonized by others on here won't be helpful....  So see what Thor can do; perhaps Private Message him... Either way, I wish you the best of luck fella...
