Please do not post incorrect information. The FAA has repeatedly said the 400ft rule for SEC 336 operators is a guideline not a law. I wrote to the FAA this month and the reply about the 400ft limit was this. "There is no legal requirement to fly under 400ft for those operating under Section 336."
"(c) Model Aircraft Defined.--In this section, the term ``model aircraft'' means an unmanned aircraft that is--
(1) capable of sustained flight in the atmosphere;
(2) flown within visual line of sight of the person operating the aircraft;
and (3) flown for hobby or recreational purposes."
Its gotta be within VLOS obviously, and you can hardly see your drone past 600ft depending on its size. (and that message wasn't this month... it was last February.) The FAA needs to update their rules, because I find that many people are confused about their current rules that were made 6 YEARS AGO. 6 years ago you didn't really have this technology where you could control the drone from just looking at your phone and flying miles away. Also by saying that you can fly past 400 feet, it is promoting people to do it, and I know my local police helicopter loves to fly at about 500 feet or maybe lower, so there are manned craft that fly that low. But thanks for the info, I didn't fully know that the 400' was a guideline, I heard different sides, but that FAA email clarified, thank you! |
