Guidelines are not LAW. Also there is no legal requirement for Sec 336 Hobby operators to stay below 400ft.  It's a guideline not a law.

Aloha fans55,

     The last time I checked, the FAA noted that flying over cars is not a problem because the shell of the car protects the people inside.  But flying over roads and in particular in line with and over a road with traffic is not allowed because a drone failure can land in traffic and cause a crash, possibly fatal.

     When a rule for drones says not to fly over people, flying over houses, cars and buildings is usually allowed because the structure protects those inside.  Flying over people exposed in the open like at a sporting event or concert is not allowed due to the threat to safety for the people in attendance.  Special permission is required for those events.
