It's complicated. Much of Manhattan is actually open airspace according to the FAA. And another part of it is accessible via the LAANC system. The prohibition against flying over people is less of an issue now, as there are so few people out & about. The remaining issue is an old city law from the 1940s, which prohibits aircrafts taking off or landing in the city outside of airports. Supposedly this law may soon be changed to accommodate drones, but for now it technically remains an impediment. In my experience, it is rarely enforced, so, if you are a responsible licensed pilot, this is a good time for getting footage of the city.
It would be nice if someone would fly in Times Square or at least around Central Park. I personally wouldn't though because people could question but considering how dead it is, I don't think you would have an issue if you just go straight up in the open. Law enforcement is mostly based upon common sense.
You could work with the government to give them photos so the leaders can know what they are working with but with permission first, then you are pretty much clear to fly at your own discretion. |
