Thats not the decision of DJI but of the laws of your jurisdiction.

It will depends why it crashed. If it crashed because a propeller flew away or the gps module had a malfunction its warranty no matter what and if even you used a software. It flies with RC without software also.

If of course it crashed because of a bug in Autoflight software its not DJI warranty but you can ask Autoflight devs for compensation.

The flight records and the aircrafts condition will reveal who was responsible.

The aircraft can fly without using a app turned on...  

If you eliminate the App and the issue is caused by some other defect... then it should be covered.  It is not fair to assume that DJI should cover everything and third party Apps. I believe the AutoFight Logic 2.0 is a great product and I  beta tested it on my Inspire without any issues.
