I have to new Phantom 2 ver2

one of my motors stall during start up and also flight.

I have not crashed, landed upside down or in anyway had dirt or moisture enter the motor.

Is this a bearing fault with the stater or an ESC Issue

when I start up my phantom the motor CCW MOTOR 1 stutters and does not rotate until 100% is delivered.

also during flight it stalls

I would replace the ESC board for that motor.  When you first start the motors up, it doesn't rotate at all?

It is the ESC that is defective. I would look at the soldier joints for the motor wires. There are 3 connecting to the ESC. There has been many posts about cold soldier joints from the factory. The joints should have a nice shiny look. If the joints look dull or grainy I would redo the soldier before replacing the ESC.

when in flight and I change my direction of flight ie yaw the motor loses power and stalls

i think it's ESC malfunction when the power suddenly rise, try to contact your dealer for maintenance.
