Amazon.ca themselves do not carry the drones nor do they do fulfilment for them. So it must be a third party merchant sold and shipped. Its a hit and miss with third party merchants. Luckily I've purchased things from the good ones.

it is impossible. I received mine in perfect condition. I bought from DJI store. That's definitely somebody sold him a used item. All he needs to do is to return it to Amazon. DJI has nothing to do with it.

Without looking at the flight record to see where the flying was done, it's impossible to say it's impossible.
FInding 1 or 2 flight records on a new Phantom doesn't necessarily mean the Phantom is used.

I'm sorry you are experiencing issues, have you calibrated the sensors in the assistant2 software to see if that helps?

Sounds like it may be an Amazon issue.
Also, you said you tried one out from Apple. What was the reason for returning that one?

This is true.

I keep getting logs when I sync from somebody in Texas. It happens every now and then for a reason I can't figure out. So weird and the dates are all over the place.

Did you buy it from - multirotorheli.ca  - in Calgary. Stay away from those people.  

I really doubt that it came from DJI like that. Something happened before you got it. Actually if someone else had used it DJI would have that on record for that serial number. That is why you have to connect with DJI to activate it.

Clearly got yourself a REFURB.
I would suggest that since you got this from a Amazon third party selling to make comments about this so other know that selling is selling used Phantoms for full price.

Did you have to register the craft before you entered camera view? If not then the craft was used.

Quick question you are in Canada right?
So why when there are a handful of dealers available to you would you purchase from Amazon of all outlets?
When you had so many other credible dealers and avenues to choose from.
Example...
Flyin Cameras out of Chilliwack BC
MultiRotorHeli out of Calgary AB
Great Hobbies Edmonton and other provinces.
Apple stores in every major city in Canada.
Or DJI direct woukld have been a good choice...
Each to their own but I would not buy anything from Amazon knowing full well they use other fly by night vendors on an item like this, for your sake I hope you can return it as I would have a soon as I opened the box.
Suggest sticking to your post title and send it back asap instead of debating it!

Yeah purchased mine in 3/18/16 updates all the time I turn it on, had to get another device for display phone can't take updates,  got this Phantom too early should have waited a year after just like new cars wait for results.

I don't know what you are talking about but I've spent tons of money with them with zero problems. They are an official reseller and the only authorized repair center in Canada.

Wait till you try to communicate with DJI. Better chance of getting through to the pope! They have the Chinese mind set. We as customers are a bother to them. Hopefully you paid with a Credit Card

It is starting to seem like the returns are reappearing. There is more than one post like this. I am sure the ratings are being screened. However it is probably best that they are because DJI is taking the hit for someone else's actions.

You got another one that has been used before!! Get your money back and order from DJI or B&H.
I don't have any issues with the Gimbal on mine and everything is perfectly level. Mine was a direct buy from DJI.

After all that you have been through I would go DJI direct.

What has Amazon got that 6 different DJI retailers in the capital city don't have?
You could have examined it here, before purchase...& contribute to the local economy, not an American glutton.

I'm in Italy and I'd like to buy a Phantom 4 from the DJI official reseller http://www.hobbyhobby.it... I think that it is safe to buy there as already some friends of mine did.

In Edmonton, you have multiple choices, to pick and choose from.
Besides Apple Corp, Droneology in WEM, which I already explained to you.
Great Hobbies, Staples, McBain Camera, Vistek Photography, likely a couple more. . .
But you wanted a better return policy... Instead of a great drone. Go figure.
I forgot to add Cabelas sports, off of Anthony Henday. . .

I got mine at the Apple store. It's great because they'll take it back for just about any reason!
