I just saw this yesterday. One of the comments posited that if the FAA is going to consider drones aircraft, the wouldn't this be a felony for shooting at an aircraft. I'll try to dig up the version of the article, but I can't remember where I saw it. (Too much time on the web.) But it is an interesting point.

And since when is it legal to fire a gun up into the air?

Shooting at a drone is like shoot at any aircraft.  Its a no no from the FAA.  That person would be in hot water.

It is just a matter of time before we hear something crazy about another drone pilot vs. gunman. What happened to common sense?

Well, in most cases it is forbidden to fly over some ones property without there permission, other then the police or other government agencies. However it is against the law to fire a weapon in to the sky no matter of the sercomstanses. And by the way the farmer must be hiding something?
