If you live in the UK and of course your controller is switched to CAA you fly within the restrictions in the limits of the DJI software for the CAA. If you change the controller to FCC are you then able to fly in the UK within the FCC limits. Not that I would even contemplate doing it of course I'm just wondering!

In the UK the CAA limits apply, your transmitter should be set to CE mode.
Switching to FCC in the UK is technically breaking the law set by Ofcom who regulate the airwaves.
So to answer your question, No, you can not switch to FCC mode.

Hi John. I'm not disputing the law/regulations or have any intention of breaking them, its purely hypothetical, would the quad still fly but now to the FCC regs.

The CE / FCC switch is just to set the transmitter power output.
The Phantom has no idea what the regulations are CAA or FAA its up to the pilot to fly within the rules.
So, Yes, the Phantom will fly in either mode.

You seem to be confusing CE with CAA and FCC with FAA.
CE and FCC regulate transmitting power for radio equipment.
CAA and FAA are aviation safety authorities.
