Many people exceed that limit all the time, out to sea for example. The range is determined by two things primarily, clear line of sight between the aircraft and the RC unit, meaning no buildings, hills trees etc.
The other factor is less understood, and that is proximity to sources of interference. Few people understand that the control signals are lumped into a category called 'non-essential services', meaning they have to take their chances with each other, and there are literally zillions of devices in the same radio band. So the further away from civilisation you are, the longer the range you will get.
